Agreement to Terms

By accessing or using Roam Aloha ("the App"), including our website at roamaloha.app and our iOS mobile application, you agree to be bound by these Terms of Service. If you do not agree, please do not use the App.

Roam Aloha is operated by Epic Design Labs ("we," "our," or "us").

Description of Service

Roam Aloha is a free travel discovery and trip planning tool for Hawaii. We provide curated location recommendations, itinerary planning tools, and links to third-party booking services. The App is provided "as is" and is intended for personal, non-commercial use.

Use of the App

You agree to:

  • Use the App only for lawful purposes and in accordance with these Terms
  • Not attempt to interfere with, compromise, or disrupt the App or its servers
  • Not scrape, crawl, or extract data from the App in bulk without our written permission
  • Not reproduce, distribute, or create derivative works based on our content without permission
  • Not use the App to transmit harmful, offensive, or illegal content

Content and Recommendations

All location recommendations, descriptions, insider tips, and other content on Roam Aloha are provided for informational purposes only. While we strive for accuracy:

  • Business hours, prices, availability, and conditions may change without notice
  • Recommendations reflect personal opinions of our local contributors
  • We are not responsible for your experience at any recommended location
  • You are responsible for your own safety when visiting any location, including checking weather, tides, trail conditions, and local advisories
  • Some activities involve inherent risks (ocean swimming, hiking, etc.) — use your own judgment

Trip Planning and Data

Trip itineraries you create are stored locally on your device by default. We are not responsible for data loss due to browser clearing, device changes, or app removal. When you share a trip, a copy is stored on our servers and accessible via the shared link.

Drive time estimates between stops are approximate and may not reflect real-time traffic conditions.

Third-Party Services and Booking

Roam Aloha may contain links to third-party websites and booking platforms (such as FareHarbor and Peek). When you click these links:

  • You leave Roam Aloha and are subject to the third party's terms and privacy policy
  • We are not responsible for the content, products, or services of third-party sites
  • Bookings, payments, and cancellations are handled entirely by the third-party provider
  • We may receive affiliate commissions from bookings made through our links, at no additional cost to you

Intellectual Property

All content on Roam Aloha — including text, photographs, graphics, logos, and software — is owned by Epic Design Labs or our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

"Roam Aloha" and our logo are trademarks of Epic Design Labs.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy or completeness of any content.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPIC DESIGN LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR FINANCIAL LOSS.

Our total liability for any claim related to the App shall not exceed the amount you paid to use the App (which is $0 for free users).

Indemnification

You agree to indemnify and hold harmless Epic Design Labs and its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the App after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Hawaii, United States, without regard to conflict of law principles.
